Question 4
Carolyn and Thomas married after a whirlwind romance overseas. Their marriage was
properly solemnised under a valid marriage licence, and duly registered. However, they
agreed to continue living with their respective parents until they had their own flat. Therefore,
they did not consummate their marriage.
They continued dating in the meantime.
As time passed, Carolyn and Thomas discovered that they had more differences than
common interests. Carolyn, who was a flight stewardess, was often out of town on flight
schedules.
Thomas wanted to start a family with Carolyn when their flat was allotted to them. Carolyn
told him that she did not believe that they should continue with their marriage as they were
very different in their outlooks on life. She felt that these differences would make it difficult
to make their marriage work.
Thomas was furious when he found out that another man was trying to date Carolyn.
However, he has no evidence that Carolyn was responding to that man.
He wants your opinion on whether he could end his marriage immediately. Thomas wants to
know whether this was possible. He is also upset that his status as a married person would be
something that he would have to live with for the rest of his life when he did not even start
living as a married man. (This was the first marriage for both Thomas and Carolyn)
In your response to Thomas:
A. State what facts are relevant to your considerations.

C. In your opinion, state whether Thomas would have to live being known as a ‘married

Jenny, a single and dynamic entrepreneur, runs a very successful business.
Jenny has 2 sisters, Mary and Annie, both younger than she is. Her sisters are both married,
and have 2 children each. Jenny’s parents are 80 years old, and live on their own.
On 1 January 2010, Jenny made a Will leaving all her assets to her 2 sisters in equal shares. It
was a valid Will that was properly executed.

On 30 June 2017, Jenny met with an accident and passed away. Her sisters want to know how
her assets would be distributed. Apply your knowledge in various areas of law and situations
to advise Jenny’s sisters of the following:
A. Jenny has 3 bank accounts with a total amount of $200,000 in them.

statues.
